1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Hireling ("Company," "we," "us," or "our") concerning your access to and use of the hireling.io website and our job application management services (collectively, the "Service").
By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility
You must meet the following requirements to use our Service:
- You must be at least 18 years old
- You must have the legal capacity to enter into a binding contract
- You must not be prohibited from using the Service under applicable laws
- You must provide accurate and complete registration information
By using the Service, you represent and warrant that you meet all of these eligibility requirements.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account using Google OAuth authentication. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Immediately notify us of any unauthorized use of your account
- Ensure that you log out from your account at the end of each session
- Not share your account credentials with any third party
We will not be liable for any loss or damage arising from your failure to maintain the security of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
4. Description of Service
Hireling provides a platform that enables businesses to:
- Create and customize job application forms
- Generate shareable application links with expiration dates
- Collect and manage job applications
- Upload and store applicant resumes
- Track application status and communicate with applicants
- Use AI-powered features to assist with job posting creation
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
5. Pricing and Payment
5.1 Pricing Tiers
We offer multiple pricing tiers for our Service:
- Free Trial: One-time free job posting with limited applications (up to 25)
- Paid Tiers: Subscription-based plans with varying application limits and features
Current pricing information is available on our website. We reserve the right to change our pricing at any time.
5.2 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions. We do not store your complete payment card information.
5.3 Refund Policy
All sales are final. We do not offer refunds for purchases unless required by law. If you believe you are entitled to a refund under applicable consumer protection laws, please contact us at support@hireling.io.
5.4 Free Trial Limitations
Each company is entitled to one free trial. Once used, you must purchase a paid tier to create additional job postings. We reserve the right to limit or deny free trial access to prevent abuse.
6. User Content and Responsibilities
6.1 Your Content
You retain ownership of all content you submit, post, or display on or through the Service ("User Content"), including job postings, application forms, and company information.
6.2 License Grant
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service.
6.3 Content Restrictions
You agree not to post User Content that:
- Violates any applicable law or regulation
- Infringes on intellectual property rights of others
- Contains discriminatory language based on race, gender, religion, sexual orientation, disability, or other protected characteristics
- Contains false, misleading, or fraudulent information
- Contains malicious code, viruses, or harmful software
- Harasses, threatens, or abuses any person
- Violates privacy rights of others
- Promotes illegal activities
6.4 Employment Law Compliance
You are solely responsible for ensuring that your job postings and hiring practices comply with all applicable employment laws, including but not limited to anti-discrimination laws, wage and hour laws, and privacy laws. We are not responsible for your compliance with employment laws.
6.5 Content Moderation
We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable. We do not pre-screen User Content.
7. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks
- Use any automated means to access the Service or collect data from the Service (scraping, bots, etc.)
- Transmit any viruses, worms, defects, Trojan horses, or other malicious code
- Use the Service for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove, alter, or obscure any proprietary notices on the Service
- Create derivative works based on the Service
8. Intellectual Property Rights
8.1 Our Intellectual Property
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Hireling, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with these Terms.
8.3 Trademark
The Hireling name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Hireling. You may not use such marks without our prior written permission.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
You agree that we may process your personal data in accordance with our Privacy Policy. If you collect personal information from job applicants, you are responsible for complying with all applicable data protection laws, including providing appropriate privacy notices to applicants.
10. Third-Party Services
The Service may contain links to third-party websites or services, including but not limited to Google (authentication), Stripe (payments), and Anthropic (AI features). We are not responsible for the content, privacy policies, or practices of any third-party websites or services.
Your use of third-party services is subject to their respective terms and conditions and privacy policies.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
- THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- THAT DEFECTS WILL BE CORRECTED
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIRELING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS
- LOSS OF DATA
- LOSS OF GOODWILL
- SERVICE INTERRUPTION
- COMPUTER DAMAGE OR SYSTEM FAILURE
- COST OF SUBSTITUTE SERVICES
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Hireling and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service
- Your User Content
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Your employment practices or hiring decisions
14. Dispute Resolution
14.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@hireling.io. We will attempt to resolve the dispute informally by contacting you via email.
14.2 Binding Arbitration
If the dispute cannot be resolved informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
14.3 Class Action Waiver
YOU AND HIRELING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby irrevocably consent to personal jurisdiction and venue therein.
16. Term and Termination
16.1 Term
These Terms remain in full force and effect while you use the Service.
16.2 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.
16.3 Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
16.4 Effect of Termination
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Service and updating the "Last Updated" date.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hireling regarding the Service and supersede all prior agreements and understandings.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
18.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.
18.5 Force Majeure
We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
18.6 Export Control
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce.
